These Terms of Service (“Terms”) govern your use of the Stackimus website and application (collectively, “Stackimus”, “we”, “our”, or “us”). By accessing or using Stackimus, you agree to these Terms. If you do not agree, do not use Stackimus.
1. Purpose and Nature of Stackimus
Stackimus is an educational software platform designed to help users study and improve their understanding of poker strategy through artificial intelligence (AI) analysis and simulated play.
Stackimus:
- Does not connect to or interfere with any online poker platform or casino software;
- Does not provide real-time automation or live-play cheating assistance;
- Should only be used in training, practice, or educational settings (for example, simulations, friendly matches, or approved offline clients such as PokerTH).
Use of Stackimus on real-money poker sites may violate those platforms’ Terms of Service; users are solely responsible for ensuring compliance with the rules of any poker site they access.
2. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use Stackimus. By using Stackimus, you confirm that you have the legal capacity to enter into this agreement and that you will use Stackimus for lawful, educational purposes only.
3. Account Registration
To use certain features of the App you may be required to create an account. When registering you agree to:
- Provide accurate and up-to-date information;
- Maintain the confidentiality of your login credentials;
- Be responsible for all activity under your account.
We may suspend or terminate accounts that breach these Terms or otherwise misuse the platform.
4. Acceptable Use
You agree not to:
- Use Stackimus in conjunction with or during live-money poker games;
- Use Stackimus to gain an unfair advantage in any gambling or competitive environment;
- Attempt to access, extract, or interfere with data from any third-party poker software or site;
- Submit unlawful, harmful, or misleading content;
- Interfere with the operation, security, or integrity of Stackimus;
- Reverse-engineer, decompile, or redistribute the App without written permission.
Misuse of Stackimus for cheating or other advantaged play may result in account termination and potential legal consequences.
5. Data Collection and Privacy
Stackimus collects and processes limited information necessary to provide and improve the service, including:
- User-submitted hand histories and pseudonymised opponent data;
- Aggregated statistical information used to train AI models;
- Website analytics, including Google Analytics.
Opponent identifiers (for example, player@casino) are cryptographically hashed before storage. Stackimus does not store or display personally identifiable information in raw form.
By using Stackimus you agree to the terms of our Privacy Policy, which explains in detail how data is processed, retained, and protected.
6. Ownership and Intellectual Property
All software, algorithms, text, graphics, and content within Stackimus are the exclusive property of Stackimus or its licensors. You are granted a personal, non-commercial, revocable license to use Stackimus for training and educational purposes only.
You may not copy, modify, distribute, or sell any portion of the App or its components, nor claim ownership of Stackimus-generated content.
7. Community Data Contribution
By submitting hand histories or related data you grant Stackimus a non-exclusive, worldwide, royalty-free license to use, process, and store the data for AI training and statistical modeling and to share aggregated, anonymised insights with other users.
Submitted data remains pseudonymised. Users may request deletion of data associated with their account or handle by contacting privacy@stackimus.com.
8. Disclaimer of Warranties
Stackimus is provided “as is” and “as available,” without any warranty of any kind. We make no representations or warranties regarding the accuracy, completeness, or fitness of the AI outputs. We do not guarantee that the App will be uninterrupted or error-free.
Your use of Stackimus is at your own risk; the software is designed for learning and not as a means to win money.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Stackimus and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or reputational harm arising from your use or misuse of the App.
This includes liability for bans, suspensions, or penalties imposed by third-party poker platforms.
10. Indemnification
You agree to indemnify, defend, and hold harmless Stackimus, its owners, officers, and affiliates from any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the App;
- Your violation of these Terms;
- Your breach of any third-party Terms of Service or local laws.
11. Termination
We may suspend or terminate access to Stackimus at our discretion if you breach these Terms, use the software for non-educational or unethical purposes, or if we choose to discontinue the App or change its business model. Upon termination your license to use Stackimus ends immediately.
12. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted at https://stackimus.com/terms with a revised “Last Updated” date. Continued use of Stackimus after updates constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved in the courts of England.
